These Terms & Conditions apply to purchases made by consumers through caythorpecandles.co.uk. They are intended to be read alongside our Returns, Refunds & Cancellation Policy, Delivery Policy, Privacy Policy and Cookie Policy.
1. About us
Caythorpe Candles is a small, independent home-fragrance business based in Caythorpe, Nottinghamshire. Our products include candles, wax melts, diffusers and room sprays.

2. Using our website
You agree to use the website lawfully and not to misuse, disrupt or attempt to gain unauthorised access to the website or its systems.
Product descriptions, photographs, fragrance descriptions and availability are provided to help you make an informed purchase. We take reasonable care to keep them accurate, but colours and appearance may vary slightly between screens and individual handmade or small-batch products.
3. Products and availability
We make products in small batches and may change, withdraw or replace products or fragrances. If a product becomes unavailable after you place an order, we will contact you and, where appropriate, offer a refund or another remedy.
Because our products are handmade, minor variations in appearance may occur. These do not necessarily indicate a fault.
4. Product safety
Home-fragrance products must be used only as instructed. Always follow the safety and care information supplied with the product and any warnings on its packaging.
Do not leave a burning candle unattended. Keep candles, wax melts, diffusers and room sprays away from children, pets, heat sources and flammable materials, and use each product only for its intended purpose.
If you have a question about the safe use of a product, contact us before using it.
5. Prices and payment
Prices are displayed in pounds sterling and include VAT where applicable. Any delivery charge will be shown before you complete your purchase.
We use the payment services made available through our ecommerce platform. We do not ordinarily receive or store your full payment-card details ourselves.
We take reasonable steps to ensure pricing information is accurate. If we discover an obvious pricing error, we will contact you before fulfilment where practicable.
6. Placing an order and contract formation
Your order is an offer to buy the products shown in your order. An order acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it.
A contract is formed when we accept your order, normally when we confirm that the products have been dispatched or otherwise expressly confirm acceptance. If we cannot accept your order, we will tell you and refund any payment taken.
These terms do not affect your statutory rights.
7. Delivery
Delivery arrangements, estimated times, charges and what to do if an order is delayed are set out in our Delivery Policy.
Unless a different delivery period has been agreed with you, consumer goods should be delivered without undue delay and, in general, no later than 30 days after the contract is entered into. If we fail to deliver within the agreed or legally applicable period, you may have rights to require delivery or cancel the contract, depending on the circumstances.
8. Cancellation, returns and refunds
Our separate Returns, Refunds & Cancellation Policy explains your statutory 14-day cancellation rights for qualifying distance contracts, our additional 30-day goodwill return period and the remedies available for faulty, damaged, incorrect or misdescribed goods.
Nothing in these Terms & Conditions excludes or restricts rights that cannot legally be excluded, including rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.
9. Personalised and made-to-order products
Where products are made to your specific requirements or clearly personalised, the statutory cancellation right may not apply. This does not remove your rights if the product is faulty, not as described or otherwise fails to meet the requirements of consumer law.
10. Intellectual property
Website content, branding, photographs, product descriptions and other materials belonging to Caythorpe Candles may not be copied, reproduced or commercially used without permission, except where permitted by law.
11. Reviews and customer content
If you submit a review, photograph or other content to us, you confirm that it is your own content and does not infringe another person's rights. We may use customer reviews or content for legitimate business purposes where we have permission or another lawful basis to do so.
12. Liability
Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to the above, we are responsible for losses that are reasonably foreseeable and caused by our breach of these terms or failure to take reasonable care. We are not responsible for losses that could not reasonably have been anticipated.
13. Privacy and cookies
Our Privacy Policy explains how we collect and use personal information. Our Cookie Policy explains the cookies and similar technologies used by the website and how you can manage non-essential cookies.
14. Governing law
These terms are governed by the law of England and Wales. If you are a consumer, you will also benefit from any mandatory protections provided by the law of the part of the UK in which you live where applicable.
15. Changes to these terms
We may update these terms from time to time. The version applying to your order will normally be the version in force when you place your order.
